AGREEMENT BETWEEN THE PROPERTY OWNER AND THE CUSTOMER.


MEANINGS OF WORDS USED.
I,we,us means DJ. Stephenson, 58 Forest Road, Heswall, Wirral. CH60 5SW
Property means Pump View, 2 Kinloss Road, Greasby, Wirral, CH49 3PS, England.
Rental Price means the total price you agree to pay to rent the property from me.
Deposit means first £50 of the Rental Price.
Balance means the rental price less any deposit paid.
You means you, the customer.

1 CONTRACT.
1.1 You are agreeing that these Booking Terms will apply to your Property booking.
1.2 By completing the reservation process, you are agreeing to enter into a contract with me to book the Property and when I send you a confirmation email, I agree to enter into that contract with you.
1.3 This contract will be governed by the laws of England.

2 CARE OF THE PROPERTY.
2.1 You must take all reasonable care of the Property and leave its furniture, pictures, fittings and effects in the same clean and tidy condition at the end of the rental period as at the beginning.
2.2 You are legally bound to pay me for replacing or repairing damaged items or for any extra cleaning/decorating costs which I believe are reasonably required as a result of your stay in the Property. However, the odd broken glass or piece of crockery is overlooked, I realise accidents can happen.

3 RENTAL.
3.1 You can rent the Property if available. I will confirm availability by email within 12 hours of you making the reservation. If the Property is unavailable I will cancel or refund any payments made.
3.2 You must not use the Property for running a business with members of the public calling or taking deliveries.
3.3 The property is in a residential area so you agree to keep prolonged noise within limits that a 'reasonable person' would find acceptable.

4 RESERVATIONS.
4.1 If you make your reservation more than six weeks before the rental period begins you must pay the Deposit at the time you make the booking. You must then pay the balance of the Rental Price no later than six weeks before the rental period begins. If I do not receive the balance of the Rental Price by that time, I will assume you have cancelled your booking and you will forfeit your Deposit. I am entitled to re-let the Property to other clients without contacting you again although I will always try to do so.
4.2 If you reserve the Property less than six weeks before the date you are due to arrive, you must pay the full Rental Price when you make the booking.
4.3 VAT is not currently payable.
4.4 Please note that the Deposit is not refundable.

5 NUMBER OF VISITORS.
5.1 You agree that the number of persons staying in the Property will not exceed four.

6 PETS.
You cannot bring pets to the Property. If you bring pets, I can ask you to leave.

7 SMOKING.
You agree that you, or any member of your party, will not smoke within the fully enclosed areas of the Property.

8 LIABILITY.
As far as the law allows, I will not be liable for any loss or damage to you, any member of your party, any third party, and any baggage, car or contents, however it arises as a result of you renting the Property.

9 ACCESS.
You must give me, or our representative, access to the Property at any reasonable time while you are renting it to carry out essential maintenance or if there is an emergency. Wherever possible, I would arrange this in advance.

10 REFUSE COLLECTION.
Wirral Council has a waste recycling policy. There are three wheely bins (green, grey and brown). You agree to place food and non-recyclable waste only in the green bin. Council documentation on what you may recycle (grey bin) will be left out for your arrival. If unsure of waste status, please use the green bin.

11 IF I CANCEL THE RENTAL.
If, after I have confirmed your booking, I cannot supply the Property to you because of reasons beyond my control, I will refund all monies, including your Deposit.

12 IF YOU CANCEL THE BOOKING.
12.1 If you cancel the booking for any reason, you must inform me in writing.
12.2 If you cancel a booking I will charge the cancellation fee set out below. The cancellation fee will depend on the time left before your rental is due to start.
(a) If I receive your cancellation up to six weeks before you are due to arrive, you will lose only your Deposit.
(b) If I receive your cancellation after six weeks before your arrival date, then you do risk losing 100% of the Rental Price unless I can re-let the property.

13 STATUTORY RIGHTS.
Nothing in these Booking Terms shall affect your statutory rights.

14 DATA PROTECTION.
By making a booking, you agree that I may store and use your information, as required, to complete your booking and allow you to stay at the Property.
